Privacy Policy

1. Introduction

This Privacy Policy (this “Privacy Policy”) describes the Personal Information that Hospital for Special Surgery (collectively, “HSS,” “we,” “us,” or “our”) may collect, and how HSS collects, uses and discloses such Personal Information when you access or use our RIIP REPS mobile application(s), our website made available at www.riipreps.com and other digital platforms made available to you (collectively, the “Platform”), as well as your choices related to your Personal Information.  

By accessing or using the Platform, you acknowledge and consent to the practices described in this Privacy Policy regarding our collection, use and disclosure of your Personal Information. If you do not acknowledge and consent to this Privacy Policy, you may not use the Platform.  In order to use the Platform, you must be at least 13 years of age. If you are under the age of majority in your jurisdiction, you may only use the Platform with the prior consent of your parent or legal guardian. Please be sure your parent or legal guardian has reviewed and discussed this Privacy Policy with you before you start using the Platform.  

Please note that the Platform is not a part of the “health care component” of HSS for purposes of the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).  This means that the Personal Information that you input into the Platform or that the Platform collects automatically about your use of the Platform, as well as any information you communicate directly with HSS about your use of the Platform, is not protected by HIPAA and HSS’s use and disclosure of such Personal Information is not subject to HIPAA.

2. The Personal Information We Collect

The categories of information we collect about you include the following:

  • “Personal Information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information can include identifiers such as your name, email address, physical address and telephone number.

  • “Session Data” is information that we collect when you use our Platform, including, for example, the training sessions you complete.

  • “Usage Data” is information that we automatically collect about your Internet or other electronic network activity, including your use of the Platform and the sort that web browsers and servers typically make available, through Web server logs, Web beacons, cookies and other similar tracking technologies, about the devices you use to access our Platform, as well as information on how you interact with our Platform. Usage Data may include the IP address of a device or internet service used to connect your device to the Internet and may provide information about your location; computer and connection information such as your browser type and version; operating system and platform; and the URLs which lead you to and around the Platform including the date and time of access. Usage Data generally does not directly identify you by name, but may constitute Personal Information in some instances.

3. How We Collect Your Personal Information

When you access or use the Platform, HSS may collect Personal Information and other data in the following ways:

  • Information You Provide to HSS: HSS collects Personal Information when you use and interact with the Platform, such as when you indicate that you have completed exercises in the Platform, your rating of training sessions, when you view resources and other content that we make available on the Platform, complete and submit forms to us on our Platform or when you communicate with HSS about our Platform whether by letter, e-mail, online chat window, or telephone. Note that any photos or videos that you capture while completing any training sessions are stored locally on your device, and are not accessible to HSS or your organization’s coaching staff, managers, teammates or your parents or legal guardians. However, your ratings of particular training sessions is available to your coaching staff and managers.

  • Information that HSS Collects Automatically: When you use the Platform, HSS may automatically collect Session Data and Usage Data subject to the settings of your device that you use to access the Platform. 

4. Use of Information Collected by HSS

HSS may use the Personal Information about you for various purposes, including to:

  • Provide, maintain and improve our Platform and provide you with relevant information;

  • Send you technical notices, updates, security alerts and support and administrative messages;

  • Respond to your comments, questions and requests and provide customer service;

  • Monitor and analyze trends, usage and activities in connection with our Platform;

  • Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of HSS and others; and

  • Carry out any other purpose described to you at the time the information was collected.

5. Data Collection Technologies

We and our service providers may use various tracking technologies, including cookies and web beacons, to collect information about you when you interact with our Platform. Cookies are small data files stored on your hard drive or in device memory that help us improve the Platform and your experience, see which areas and features of the Platform are popular, and count visits. Web beacons are electronic images that may be used on the Platform or emails and help deliver cookies, count visits and understand usage and campaign effectiveness. For more information about cookies, and how to disable them, please see “Your Choices” below.

Notice concerning Do Not Track. Do Not Track is a privacy preference that users can set in certain web browsers. Some web browsers offer users a “Do Not Track” privacy preference setting in the web browser. We do not currently recognize or respond to browser-initiated Do Not Track signals.  

6. Disclosing Your Information

We may share information about you, including Personal Information, as follows, or as otherwise described in this Privacy Policy:

  • We share Session Data with your organization’s coaching staff and managers in order for them to monitor the sessions you and your teammates complete. Note that while your teammates are able to view data about how many sessions each teammate has completed, your teammates do not have access to more detailed information, including, for example, data on your performance during the training sessions you complete.

  • We share Session Data with your parent or guardian in order for them to monitor the sessions you and your teammates complete. 

  • With vendors, consultants and other service providers who need access to such information to carry out work or perform services on our behalf, including the analytics service providers discussed in Section 7 below (“Analytics Services Provided by Others”);

  • In response to requests from local, state, provincial or federal law enforcement officials, any judicial, administrative or similar proceeding or order, such as a subpoena if we believe disclosure is in accordance with, or required by any applicable law;

  • If we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property and safety of HSS and others;

  • To investigate suspected fraud, harassment, physical threats, or other violations of any law, rule or regulation, the Platform’s rules or policies, or the rights of third parties or to investigate any suspected conduct which we deem improper;

  • In connection with, or during negotiations of, any merger, sale of company assets, financing, licensing or acquisition of all or a portion of our business, including the Platform, by another company;

  • To third-party companies that provide sponsorship of the Platform;

  • Between and among HSS and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership;

  • With your consent or at your direction;

  • To comply with transparency or other public reporting obligations; and

  • As otherwise permitted or required by law.

We may also share aggregated or de-identified information, which cannot reasonably be used to identify you.

7. Analytics Services Provided by Others

We may allow others to provide analytics services on our behalf. These entities may use cookies, web beacons and other technologies to collect information about your use of the Platform and other websites, including your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. 

For example, we use analytics vendors (such as Google Analytics, Squarespace, and Amplitude) to help us analyze and track data, determine the popularity of certain content and better understand your activity on our Platform. We share data, including Personal Information, Session Data and Usage Data with such analytics vendors for these purposes.

8. Security of Personal Information

HSS has reasonable and appropriate safeguards in place to help protect the Personal Information HSS collects from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Although HSS attempts to protect the Personal Information in our possession, no security system is perfect, and HSS cannot promise that your Personal Information will remain secure in all circumstances.

9. Retention of Personal Information

HSS will retain your Personal Information as needed, and for the length of time needed, to fulfill the purposes for which it was collected. HSS will retain and use your Personal Information as necessary to comply with HSS’s business requirements, legal obligations, resolve disputes, protect our assets, and enforce our agreements. 

10. Links to Third Party Websites

Our Platform may contain certain links to third party websites. HSS is not responsible or liable for the privacy practices or content found on these websites. You should check the privacy notice and policies of each website you visit. Links to third party websites are provided solely for your convenience and any use or submission of data to such websites shall be at your sole risk.

11. United States Only

The Platform is intended for use only in the United States of America. If you use the Platform or contact us from outside of the United States of America, please be advised that (i) any information you provide to us or that we automatically collect will be transferred to the United States of America; and (ii) by using the Platform or submitting information, you explicitly authorize its transfer to and subsequent processing in the United States of America in accordance with this Privacy Policy.

12. Changes to the Privacy Policy

HSS may change this Privacy Policy at any time. Unless we say otherwise, changes will be effective upon the last updated date at the top of this Privacy Policy. Please check this Privacy Policy regularly to ensure that you are aware of any changes. We may try to notify you of material changes to this Privacy Policy, which if we do so may be by means such as by posting a notice directly on the Platform, by sending an e-mail notification (if you have provided your e-mail address to us), by sending an in-app notification, or by other reasonable methods. In any event, if you use the Platform after changes to this Privacy Policy are made, you have accepted the changes. If you do not agree with the changes, please stop using the Platform.

13. Your Choices

Account Information

You may update, correct or modify information about you at any time by logging into your account. If you wish to deactivate your account, please email us at help@riipreps.com, but note we may continue to store information about you as required by law or for legitimate business purposes.

Native Applications on Mobile Device 

Some features of our mobile applications may require access to certain native applications on your mobile device, such as the address book, camera and photo storage applications, microphone and other native applications. If you decide to use these features, your mobile device will ask for your consent prior to accessing the applications and collecting information. Note that you can revoke your consent at any time by changing the settings on your device.  Please be advised of how this information is used, accessed, stored and shared:

Camera

Our Platform may allow you to use your camera to take new photos or to capture video in a recording that can be used during a training session. Note that any photos or videos that you capture are stored locally on your device, and are not accessible to HSS or your Organization’s coaching staff, managers, other teammates or your parents or legal guardians.

Address Book

Our Platform may allow you to access your contacts from your address book application on your device to complete form fields in the Platform for the purpose of inviting coaches, organization managers, team athletes and their parents or legal guardians to access the Platform.

Microphone

Our Platform may allow you to use your microphone to capture audio associated with videos that you capture. 

Cookies and Your Analytics Choices

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of the Platform. 

Push Notifications

With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.

SMS Text Messages

We may send SMS text messages to the phone number you provided in accordance with our Terms of Use.  See the “Communication Preferences” section of our Terms of Use for more information about the SMS text messages we may send you.
